Business Litigation
Although the attorneys at Needham, Kepner, Fish & Jones focus on personal injury matters, we also have significant experience in handling business litigation matters throughout the Bay Area. We help both small and large businesses pursue and defend a variety of cases involving:
Real Estate
Disputes can arise at any point in the real estate process, including planning and developing, building, buying and selling, closing, financing, leasing, and foreclosing. Our broad experience includes handling cases at all points in the process for small and large properties, developed and undeveloped properties, involving as many as 170 locations. In particular, we represent title companies and banks in a variety of actions, including resolving easement disputes and quiet title actions.
We also have unique experience handling mobile home fee litigation under California's Mobilehome Residency Law. It is becoming increasingly popular for mobile home park managers to levy fees on homeowners. However, the law places numerous restrictions on these fees, and we have a represented a wide range of homeowners in these complex matters.
Breach of Contract
We understand that most important business relationships are based on successful contractual arrangements. Firm member Brad Jones represents numerous Silicon Valley companies in actions to recover on accounts or contracts encompassing an array of agreements, including real estate, construction and contractor, supplier, and distribution agreements.
Construction
Construction projects frequently involve a range of unique legal issues. We represent owners, builders, and construction contractors in a variety of construction matters, including defects, mechanic's liens, and contractual disputes. These cases are often complex, involving multiple parties, including developers, owners, design professionals, general contractors, subcontractors, suppliers, and lenders.
We handle a diverse array of construction defect claims, including those arising due to poor workmanship by contractors and builders, design defects, material problems, subcontractors or supplier defaults, departures from plan specifications, and building code violations. Our experience in personal injury matters also gives us the ability to also handle defect matters that result in toxic exposure injuries, such as using faulty or dangerous parts, inadequate warnings on toxic chemicals and adhesives, and construction that results in mold or other contamination.
Trade Secrets
Trade secrets are the confidential and proprietary information that gives one company a competitive advantage over its competitors. In the technology-rich Silicon Valley, guarding against theft and misappropriation of trade secrets can be critical to the success of a business. At Needham, Kepner, Fish & Jones, our attorneys have a wealth of experience handling cases in California, which has adopted the Uniform Trade Secrets Act.
When a business proves that a competitor has violated the Uniform Trade Secrets Act, that business may be entitled to substantial damages encompassing disgorgement of profits, exemplary damages, and recovery of legal fees. However sensitive, confidential information is not automatically considered trade secret; as attorneys with an in-depth understanding of trade secret cases, we know where the courts draw the line, and closely monitor any changes in the law that might alter this line.
